Terms and Conditions

These terms apply to every valuation we prepare and to your use of this website. They are written to be read, not to be skimmed past. The two clauses that matter most to you are what the report is for, and who is entitled to rely on it.

Who you are contracting with

When you order a valuation from this website you are contracting with Valuation Reports Pty Ltd, ABN 51 641 882 902, of Level 2, 70 Hindmarsh Square, Adelaide SA 5000. In these terms, we, us and our mean that company, and you means the person or entity named as the client on the order.

Placing an order means you accept these terms. If we have signed a separate written engagement with you, that engagement applies to the extent of any inconsistency with this page.

What we provide

A desktop valuation report setting out our opinion of the market value of a property as at a date you specify, with the evidence and reasoning behind it, prepared and signed by a Certified Property Valuer.

Desktop means we do not physically inspect the property, inside or out. The opinion is formed from:

  • Documented comparable sales evidence for the market the property sits in, around the valuation date
  • Title, land and local government records, and licensed property data
  • The property attributes you give us

The report is prepared for tax purposes: establishing or supporting a cost base, a market value at a particular date, or a market value substitution. See how the process works for what happens between order and delivery.

What the report is not

Read this before you order. If you need any of the following, tell us first and we will tell you whether we can help.

  • It is not a mortgage security valuation and is not prepared for a lender
  • It is not a pre-purchase or pre-sale appraisal and it is not a real estate agent appraisal
  • It is not a rental assessment or an insurance replacement cost assessment
  • It is not a building, pest or structural inspection. We do not attend the property, so we cannot report on its physical condition beyond what you tell us and what the records show
  • It is not prepared for compulsory acquisition, or for litigation or an expert witness role where a physical inspection is required

Important

The report is evidence of value. It is not tax advice.

The report tells you what the property was worth at a date and shows the evidence for that figure. It does not tell you how capital gains tax applies to you, whether an exemption or concession is available, how to apportion a gain, or what to put in your return. We do not provide tax advice through this service. Speak to your tax agent or accountant about how the figure is used.

What we need from you

The quality of the report depends on the accuracy of what you give us. You agree to give us complete and accurate information, including:

  • The correct property address and title particulars
  • The exact valuation date
  • The property's attributes as at that date
  • Anything that affects value, such as an easement, heritage listing, encumbrance, structural defect, contamination, subdivision potential, or a renovation and when it was completed

The most common error

Retrospective dates need retrospective facts

Where the valuation date is in the past, the attributes must be the ones that existed at that date, not the ones that exist today. A kitchen renovated in 2019 is not part of a 2012 valuation. If you are not sure what the property was like at the date, tell us and we will work through it with you.

If the information you give us is wrong or incomplete, the value we report will reflect that, and we are not responsible for the consequences. If you notice an error, tell us and we will reassess. See Changing or cancelling an order.

Fees, GST and payment

ReportFee (AUD inc. GST)
Residential, current or retrospective$297
Commercial, current or retrospective$595
Rural holdings, thin markets and specialised commercial assetsQuoted before we start

All fees are in Australian dollars and include GST at 10 per cent. A tax invoice is issued for every order.

Payment is due in full when you place your order, and we begin work once payment clears.

Accounting, legal and advisory firms with an account with us are invoiced in arrears rather than paying at the time of order. Those invoices are payable within 14 days of the invoice date.

Fees change from time to time. The fee that applies to your order is the one displayed when you place it.

Turnaround

We aim to deliver within 24 to 48 hours of receiving a complete order and cleared payment, counted in business days, Adelaide time.

That is a target, not a guarantee. It can extend where information is outstanding, where the property sits in a market with little sales evidence, where the valuation date is a long way in the past, or where the property is unusual. If your report is going to take longer, we will tell you and we will tell you why.

Who may rely on the report

The report is prepared for the client named in it and for the purpose stated in it.

You may give it to your accountant, tax agent, solicitor or financial adviser, and you may lodge it with or provide it to the Australian Taxation Office in support of your position.

No other person may rely on it. We accept no responsibility to anyone other than the named client, and none for use of the report:

  • for a purpose other than the one stated in it
  • for a different property, or a different valuation date
  • by a party to a transaction on the other side from you

The opinion speaks as at the valuation date. Markets move, and it is not a continuing opinion of value. A report prepared for one date cannot be repurposed for another.

Please do not extract a figure from the report and circulate it on its own. The evidence and the reasoning are what make the figure defensible, and a number without them is worth very little to the ATO.

Independence

Our fee is fixed in advance. It is not contingent on the value we report, on whether a transaction proceeds, or on the tax outcome. We will not accept instructions to reach a particular figure.

We do not act for both sides of a dispute about value. If we identify a conflict of interest, we will tell you and decline the engagement, and we will refund anything you have paid.

Questions after delivery

We will answer reasonable questions about the report, its evidence and its reasoning at no charge for three months from delivery. That includes questions raised by your accountant or tax agent.

Where a question requires new research, additional evidence, a different valuation date or a revised report, that is new work and we will quote before we start.

Changing or cancelling an order

  • Before we start research. Cancel and we refund the fee in full
  • After research starts, before delivery. Cancel and we still refund the fee
  • Once the report is delivered. The fee is not refundable, except where the Australian Consumer Law gives you a remedy. See Your rights under the Australian Consumer Law

If we prepared the report on the address, valuation date or property attributes you gave us and those turn out to be wrong, tell us and we will prepare a corrected report at no charge. The same applies if the error is ours. We would rather the file be right than argue about whose mistake it was.

We own the copyright in the report, in the methodology behind it, and in the material on this website.

On payment you receive a non-exclusive, non-transferable licence to use the report for the purpose stated in it, including giving a complete copy to your advisers and to the ATO.

You may not publish the report, post it on a website, use it in marketing or a prospectus, or provide it to a third party so that party can rely on it, without our written consent.

Confidentiality and privacy

We treat your information, and the fact that you have engaged us, as confidential. We disclose it only where you authorise it, where it is necessary to prepare or support the report, or where the law requires it.

How we handle personal information is set out in our Privacy Policy.

Your rights under the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under that law, or any other law that cannot lawfully be excluded.

Limitation of liability

Subject to Your rights under the Australian Consumer Law, and to the extent the law permits:

  • Our liability for failing to comply with a consumer guarantee is limited to supplying the service again, or paying the cost of having it supplied again
  • Our total liability arising out of or in connection with a report, however arising, including in contract, tort, negligence or under statute, is limited to $500,000
  • We are not liable for indirect or consequential loss, or for loss of profit, loss of opportunity, or any tax, penalty, interest or general interest charge assessed against you

We are not liable for loss caused by:

  • Information you gave us that was wrong, incomplete or out of date
  • Use of the report for a purpose other than the one stated in it
  • Reliance on the report by anyone other than the named client
  • A change in the market, in the law, or in ATO practice after the date of the report

We hold professional indemnity insurance. The cover is held by Valuation Reports Pty Ltd and responds to the valuation work described in these terms.

Changes to these terms

We update these terms from time to time. The version on this page when you place your order is the version that applies to that order. The date at the top of the page shows when they last changed.

Governing law

These terms are governed by the law of South Australia. You and we submit to the non-exclusive jurisdiction of the courts of South Australia and the courts that hear appeals from them.

If any part of these terms is unenforceable, it is severed and the rest continues to apply.
