Privacy Policy

This policy explains what personal information we collect when you order a property valuation or use this website, why we collect it, who we give it to, and how you can access it, correct it or complain about how we have handled it.

Who we are

This website is operated by Valuation Reports Pty Ltd, ABN 51 641 882 902, an Australian private company with its office at Level 2, 70 Hindmarsh Square, Adelaide SA 5000. In this policy, we, us and our mean Valuation Reports Pty Ltd.

We handle personal information in accordance with the Australian Privacy Principles in the Privacy Act 1988 (Cth).

What this policy covers

This policy applies to personal information we collect through this website, our order system, email and telephone contact, and the preparation and delivery of valuation reports.

It does not apply to information you give directly to your own accountant, tax agent, solicitor or financial adviser, or to third party websites we link to. Those parties have their own privacy policies and you should read them.

The information we collect

When you order a valuation

  • Your name, email address, telephone number and postal address
  • The address of the property and its title particulars
  • Your relationship to the property, for example owner, executor, trustee, beneficiary or adviser
  • The valuation date you need and the reason you need it
  • Property attributes you tell us about, including land size, building area, rooms, car parking, construction, condition, improvements, renovations and any known defects
  • Documents you send us. These commonly include contracts of sale, title searches, council rates notices, floor plans, photographs, building or pest reports, depreciation schedules, grants of probate or letters of administration, and family law orders
  • Billing details and payment records
  • Your correspondence with us

We do not need your tax file number to prepare a valuation and we do not ask for it.

When you use this website

Our web server and analytics record your IP address, browser and device type, the pages you view, the page that referred you, and the date and time of your visit. See Cookies and website analytics below.

Sensitive information

Deceased estate and family law documents

Documents supplied in deceased estate and family law matters can contain health information, information about a person's death, or details of a relationship breakdown. We collect this only because you have chosen to send it and only where it bears on the valuation. We do not seek sensitive information otherwise, and we do not use it for any purpose other than preparing your report and keeping the file that supports it.

Information about other people

Valuations often involve more than one person. Where you give us personal information about someone else, for example a co-owner, an executor, a beneficiary or a former spouse, you should make sure that person knows we hold it and can read this policy. We rely on you having the authority to give it to us.

How we collect it

Wherever we can, we collect personal information directly from you, through our order form, by email, by telephone, or from documents you send us.

We also collect it:

  • From your adviser. Where your accountant, tax agent, solicitor or financial adviser places the order or corresponds with us on your behalf
  • From public and licensed records. Land titles registries, local government records, published sales evidence and licensed property data services. Records of past sales and property attributes obtained from those sources can include personal information such as the names of past owners, and that information forms part of the evidence in the report

Why we collect it and how we use it

  • To prepare, review, sign and deliver your valuation report
  • To identify the property correctly and confirm that you are entitled to request a valuation of it
  • To select, verify and document the comparable sales evidence the opinion rests on
  • To answer your questions, and your adviser's questions, about the report
  • To invoice you and process payment
  • To keep the working file that supports the opinion. A valuation prepared for tax purposes can be examined years after the return is lodged, so retaining the file is part of the service
  • To meet our record keeping, tax and other legal obligations
  • To send you service messages and, unless you have opted out, occasional information about our services

We do not sell personal information.

Who we disclose it to

  • Our own people, where they need it to prepare, review or deliver the report
  • Your adviser, where you have asked us to deal with them or they ordered on your behalf
  • Our service providers, including website and email hosting, our order and payment systems, document storage, accounting and practice management software, and IT support. Each is required to protect the information and use it only to provide the service to us
  • The Australian Taxation Office, a court or a tribunal, where the report is used to support a tax position or in proceedings, or where we are compelled to disclose
  • Our professional advisers and insurers, where it is necessary

We do not disclose your personal information to anyone else without your consent, unless the law requires or permits it.

Where your information is stored

Your information is stored in Australia. Our email, documents and valuation files are held on Google servers in Australian data centres. We do not store your information overseas.

Some administrative and support work behind our reports is carried out by team members located outside Australia. Where that happens they work inside those same Australian systems, under written confidentiality obligations, restricted access and supervision by our Australian team. We do not disclose your information to an overseas organisation for that organisation's own purposes.

This website is delivered through a content delivery network, which caches published pages on servers in various locations so that they load quickly. That cache holds public page content only. Anything you send us through the order form or by email goes to our Australian systems.

How we protect it

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Those steps include:

  • Individual logins and access limited to the people who need it
  • Encryption of this website and our order system in transit
  • Storing files in access controlled business systems rather than on personal devices
  • Written confidentiality obligations on everyone who works with us
  • Removing access promptly when someone leaves

No system is completely secure. We cannot guarantee against every risk, but we will act quickly if something goes wrong. See Data breaches.

How long we keep it

We keep valuation files, and the evidence supporting the opinion in them, for seven years from the date of the report. A valuation prepared for capital gains tax purposes can be examined long after the return is lodged, so retaining the supporting file is part of what you are paying for.

Seven years also covers the periods we are required to keep records: at least five years under tax law, and seven years for financial records under the Corporations Act 2001 (Cth).

Where information is no longer needed for any purpose set out in this policy and we are not required by law to keep it, we destroy it or de-identify it.

Cookies and website analytics

This website uses cookies. Some are necessary to make it work, for example holding your session and keeping the order form secure. The rest are analytics cookies.

The only analytics we run is Google Analytics 4. It tells us how many people visit, which pages they read, how they found us and roughly where in the world they are, which is how we work out which guides are worth writing more of. Google Analytics 4 does not store individual IP addresses. We do not use it to identify you or to build a profile about you.

We do not run advertising or social media tracking pixels on this site.

You can block or delete cookies through your browser settings, and you can opt out of Google Analytics entirely using Google's browser opt-out add-on. If you block the necessary cookies, parts of the site and the order system will stop working.

Direct marketing

We may send you information about our services by email. Every marketing email carries an unsubscribe link, and you can also opt out at any time by emailing hello@cgtvaluation.com.au. We will action it promptly.

We do not use sensitive information for marketing, and we do not provide your details to other organisations for their marketing.

Opting out of marketing does not stop messages about a valuation you have ordered.

Accessing and correcting your information

You can ask for a copy of the personal information we hold about you, and ask us to correct it if it is wrong, out of date, incomplete or misleading. Email hello@cgtvaluation.com.au. We may ask you to verify your identity before we release anything.

We will respond within 30 days. There is normally no charge. If a request would take substantial work we will tell you what it will cost before we start, and you can withdraw the request.

Worth knowing

Correction is not the same as changing the valuation

We will correct personal information that is wrong. That is different from changing the opinion of value in a delivered report. If a property fact we relied on was wrong, tell us and we will look at it, because the report should rest on correct facts. If you simply disagree with the figure, the report stands and you are free to note your disagreement.

The Privacy Act allows us to refuse access or correction in limited circumstances. If we do, we will tell you why in writing and explain how to complain.

Data breaches

If personal information we hold is lost, or accessed or disclosed without authorisation, we will contain it and assess it promptly. Where a breach is likely to result in serious harm, we will notify the people affected and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches scheme.

Privacy complaints

If you think we have mishandled your personal information, tell us first. Email hello@cgtvaluation.com.au with Privacy complaint in the subject line, or write to us at the address below. Set out what happened and what you would like us to do.

We will acknowledge your complaint within seven days and respond in writing within 30 days.

If you are not satisfied with our response, you can take the complaint to the Office of the Australian Information Commissioner:

  • Online at oaic.gov.au
  • By telephone on 1300 363 992
  • By post to GPO Box 5288, Sydney NSW 2001

Changes to this policy

We update this policy from time to time. The current version is always on this page and the date at the top shows when it last changed. Where a change is significant we will say so on the page.
