Why Brisbane evidence needs care

  • Flood history and flood mapping. Brisbane has had major flood events, and both the physical impact and the mapping that followed affect value. For a retrospective valuation the question is what was known and how the market was pricing flood risk at that date, which can be very different from today. Properties affected in one event and not another need the timeline handled properly.
  • Character housing protections. Pre-war housing in the inner suburbs sits under controls that restrict demolition and shape what can be built. Two adjacent sites can carry different values depending on whether the dwelling is protected.
  • Queenslanders and elevation. Traditional raised housing carries value features that do not appear in a floor-area comparison, including under-house potential, elevation above flood levels, and outlook. These need to be reflected rather than averaged out.
  • Strong, uneven growth. South East Queensland has had periods of very rapid movement, including sustained interstate migration. That is exactly the pattern the compounding apportionment formula misprices for the 1 July 2027 transition.
  • Large lots and splitter blocks. Older inner and middle-ring suburbs contain allotments capable of subdivision, and value reflects that potential where the controls at the valuation date allowed it.

Common Queensland scenarios

  • The interstate move that turned a home into a rental. Section 118-192 resets the cost base to the market value on the day the property first earned income. Queensland's migration patterns make this one of the most common triggers we see here. See home to investment valuations.
  • The coastal investment property. Gold Coast and Sunshine Coast stock frequently combines holiday letting with private use, which produces a partial main residence position or a straightforward investment position depending on the facts.
  • The long-held family home in an estate. Properties held since before 20 September 1985 need a date of death value and, if retained, a 1 July 2027 value. See deceased estate valuations.
  • Transfers into trusts. Assessed on market value under sections 116-30 and 112-20 regardless of the price recorded on the transfer. See related party transfers.

CGT and Queensland state taxes

Capital gains tax is a Commonwealth tax administered by the ATO. Transfer duty and land tax are Queensland taxes administered by the Queensland Revenue Office, with their own valuation rules and timing. A valuation prepared for CGT purposes is not automatically the figure the Queensland Revenue Office will adopt, and the reverse is also true.

Related-party transfers are where the two most often meet, since the same transaction can attract duty assessed on market value and a CGT event assessed on market value under separate regimes. Confirm the state tax treatment with your accountant or conveyancer.

Valuations for stamp duty on related party transfers in Queensland

Queensland Revenue Office public ruling DA505.1.2 sets out when a valuation is required for a residential property transfer. Family transfers are named directly: the Commissioner requires a valuation where the parties are family members, where there is no consideration, or where the consideration cannot be worked out at the time the duty liability arises. Duty is then assessed on the unencumbered value, and where a valuation gives a range, on the highest ascertainable value in it.

QRO accepts a valuation from a registered valuer, or from a real estate agent who is competent, independent and able to support the figure with at least three recent comparable sales. Either is generally accepted if it is dated within three months of the transfer being signed. The ruling also warns that if the Commissioner obtains its own valuation and the declared value falls short by more than 10 per cent, or by more than $100,000 on property over $1 million, the cost of that valuation is passed to the taxpayer.

For a Brisbane family moving a Paddington cottage or a Chermside unit to the next generation, that cost-recovery rule is the reason to get the value right first time. A valuation prepared with documented comparable sales at the transfer date meets QRO's standard and is also the figure the ATO substitutes under the market value substitution rule, so the same report covers the duty lodgement and both parties' CGT positions.

For how every state and territory handles it, see our stamp duty valuation guide.

Common questions

Does flood history affect a CGT valuation?

It can, materially. Flood impact and flood mapping affect what buyers will pay, and the effect differs by date, since the market's pricing of flood risk has shifted over time. A retrospective valuation assesses what was known and how the market was responding at the valuation date rather than applying today's view.

Do you inspect Brisbane properties?

Generally no. Our reports are desktop valuations built on comparable sales and documentary evidence, which suits CGT work because most CGT valuation dates are historical. Where condition at the date is genuinely in question, tell us what you can supply about it.

How much does a CGT valuation cost in Brisbane?

Residential reports are $297 inc. GST and commercial reports are $595 inc. GST, fixed and quoted upfront, delivered in 24 to 48 hours. Retrospective dates cost the same as current dates.

Do I need a valuation for stamp duty when transferring property to family in Queensland?

Yes. QRO public ruling DA505.1.2 requires a valuation where the parties are family members or there is no consideration. It accepts a registered valuer, or a real estate agent supported by at least three recent comparable sales, dated within three months of signing. If QRO later obtains its own valuation and yours is more than 10 per cent low, you pay for theirs. One transfer-date valuation serves the duty assessment and the CGT market value substitution.

Can you value a Gold Coast or Sunshine Coast property?

Yes. South East Queensland coastal property is valued at the standard fee, with specialised assets and larger holdings quoted individually. Properties combining holiday letting with private use often carry a partial main residence position, which needs the dates and values established carefully.
