CGT Property Valuation Canberra

We prepare capital gains tax and retrospective property valuations across Canberra and the surrounding region. Independent reports signed by a Chartered Accountant and Certified Property Valuer, from $297 inc. GST, delivered in 24 to 48 hours as desktop valuations.

At a glance

  • Current and retrospective valuations for CGT, deceased estates, family law and related-party transfers across the ACT and the surrounding NSW districts
  • ACT land is held under 99-year Crown leases, not freehold, which changes what is being valued and what the evidence has to support
  • Commonwealth employment cycles and posting churn produce a steady stream of change-of-use dates
  • Residential $297 inc. GST, commercial $595 inc. GST, delivered in 24 to 48 hours
  • Reports prepared and signed by a valuer who is also a Chartered Accountant and Registered Tax Agent

Why the valuation date matters so much in Canberra

  • Leasehold, not freehold. Almost all ACT land is held under a 99-year Crown lease rather than freehold title. The lease sets the permitted use, and the remaining term and the purpose clause are part of what is being valued. Evidence has to come from comparably leased land, which is straightforward within the ACT and misleading if drawn from across the border.
  • The lease purpose clause drives development value. Where a site has redevelopment or dual occupancy potential, that potential is only real if the lease permits it or a variation is obtainable, and a charge applies on variation. A value that assumes an unrestricted highest and best use will overstate the position.
  • Loose-fill asbestos affected blocks. Properties caught by the Mr Fluffy scheme were acquired, demolished and resold as vacant land. A property's status and physical state at a past date can be very different from today, and a retrospective valuation has to reflect the date, not the current block.
  • Posting and transfer churn. Australian Public Service and Defence movements mean a high proportion of Canberra homes are rented for a period and then reoccupied, or kept while the owner is posted away. Each of those transitions carries a date that matters under section 118-192 or the six-year rule.
  • Supply arriving in waves. Apartment completions have arrived in concentrated waves in Gungahlin, Belconnen town centre and along Northbourne. Unit values in those precincts moved on their own timeline and need evidence from the same precinct and period.

Common ACT scenarios

  • The posting that kept the Canberra house. Public servants and Defence personnel posted interstate or overseas rely on the six-year rule, and on a reset date if the house was rented while they were away. See six-year rule valuations.
  • The home rented during a term abroad. A posting overseas can also make the owner a foreign resident, which removes the main residence exemption for CGT events after 30 June 2020. See expat and foreign resident valuations.
  • The Mr Fluffy block. Where a house was surrendered and demolished, what is being valued at a past date may be an improved property, and at another date bare land. The date drives the whole analysis. See retrospective valuations.
  • The long-held family home in an estate. Inner north and inner south stock is frequently pre-1985 and needs a date of death value and, if retained, a 1 July 2027 value. See deceased estate valuations.

CGT and ACT state taxes

Capital gains tax is a Commonwealth tax administered by the ATO. Transfer duty and, where it applies, land tax are the ACT taxes administered by the ACT Revenue Office, with their own valuation rules and timing. A valuation prepared for CGT purposes is not automatically the figure the ACT Revenue Office will adopt, and the reverse is also true.

The ACT has spent years progressively reducing conveyance duty and shifting the burden onto general rates, so the duty position on an older transaction can differ from the current one. Land tax also applies to rented residential property in the ACT. Both are assessed on their own basis and do not follow the CGT figure.

Related-party transfers are where the two regimes most often meet, since the same transaction can attract duty assessed on market value and a CGT event assessed on market value under separate rules. Confirm the state tax treatment with your accountant or conveyancer.

Valuations for stamp duty on related party transfers in the ACT

The ACT Revenue Office charges conveyance duty on the consideration or the unencumbered value of the property, whichever is greater. Its circular DAA010.4, Evidence of value, requires evidence of that value where the parties are related or associated persons, where the consideration is nil or nominal, where any part of it is non-monetary, or where the sale was made without a selling agent and the parties were not professionally represented.

For land with a dwelling on it, the circular accepts either a full valuation report from an accredited valuer or an agreement for sale that shows a recent arm's length transaction, dated within three months of the duty liability. For vacant land only a full valuation report will do. The value has to be assessed as at the date the transfer was first executed, on the willing-but-not-anxious buyer and seller basis, not at settlement.

Canberra transfers carry an extra wrinkle that the valuer has to handle: the property is a Crown lease, so the report values the leasehold interest in, say, a Kingston apartment or a Belconnen house, not freehold. The unencumbered value the ACT Revenue Office assesses is the same market value the ATO substitutes under the market value substitution rule, so one report dated to the execution date serves both. Confirm with your solicitor whether the valuer's accreditation matches the circular's description before you rely on it for duty.

For how every state and territory handles it, see our stamp duty valuation guide.

Common questions

Do you inspect Canberra properties?

Generally no. Our reports are desktop valuations built on comparable sales and documentary evidence, which suits CGT work because most CGT valuation dates are historical. No inspection today can record what a property was like at a past date.

Does ACT leasehold change how the property is valued?

It changes what is being valued. The Crown lease sets the permitted use and has a defined term, so the report values the leasehold interest and relies on evidence from comparably leased ACT land rather than freehold sales from across the border.

How much does a CGT valuation cost in Canberra?

Residential reports are $297 inc. GST and commercial reports are $595 inc. GST, fixed and quoted upfront, delivered in 24 to 48 hours. Retrospective dates cost the same as current dates.

Do I need a valuation for stamp duty when transferring property to family in the ACT?

Yes. ACT Revenue Office circular DAA010.4 requires evidence of value where the parties are related, the consideration is nil or nominal, or part of it is non-monetary. For improved land it accepts a full valuation report from an accredited valuer or a recent arm's length sale within three months; for vacant land only a full valuation. Duty is charged on the greater of price and unencumbered value at the execution date, which is the same market value the ATO applies for CGT.

Can you value a property in Queanbeyan or Googong?

Yes. Those are NSW freehold titles rather than ACT Crown leases, and the report uses evidence from the relevant market. Where a comparison across the border is useful, the tenure difference is stated rather than glossed over.
